Terms of Service
Last updated: November 4, 2026
Welcome to Terrabi Immobilier. These Terms of Service ("Terms") govern your access to and use of our website, services, algorithms, and applications (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms.
Acceptance of Terms
By creating an account or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (in accordance with the EU General Data Protection Regulation - GDPR). If you do not agree to these Terms, you may not access or use our Service.
Description of Service
Terrabi Immobilier is an independent real estate technology platform and metadata aggregator. We use automated algorithms and publicly accessible data to index, analyze, and benchmark property listings across Paris and French metropolitan regions. We provide search, market analytics, legal rent cap estimations (Encadrement des loyers), DPE rating audits, and notification tools to help users make informed real estate decisions.
User Accounts
To access certain features (including real-time alerts and application transmission), you must create an account. You agree to:
- Provide accurate, current, and complete information.
- Maintain the security and confidentiality of your login credentials.
- Accept full responsibility for all activities occurring under your account.
- Notify us immediately at contact@terrabi.fr of any unauthorized use or security breach.
Subscription and Payment
Our Service offers both free exploration access and paid subscription tiers:
- Free accounts have access to basic search filters and delayed property listings.
- Paid subscriptions provide real-time alerts, full historical market telemetry, and advanced valuation tools.
- Subscription fees are quoted in Euros (€), billed in advance, and processed securely via authorized European payment service providers.
- You may cancel your subscription renewal at any time through your account dashboard.
- We reserve the right to adjust pricing with reasonable prior notice.
Refund Policy (French Consumer Code Compliance)
In accordance with Article L. 221-18 of the French Consumer Code (Code de la consommation), consumers generally have a 14-day statutory right of withdrawal for distance contracts.
However, pursuant to Article L. 221-28 (1° and 13°) of the French Consumer Code, this right of withdrawal does not apply and no refund will be issued once the digital service has begun with your express prior agreement and has been substantively utilized.
Specifically, refund requests will be strictly evaluated under the following conditions:
- No Refund for Active Use: If our system logs demonstrate that you have actively consumed the Service beyond a one-time incidental visit — including, but not limited to: creating and activating live alert streams, viewing protected contact details, executing deep automated property queries, transmitting rental applications, or utilizing data during an active rental/purchase search — no refund will be granted. The Service is considered fully consumed.
- First-Time Purchases Only: Refund requests are considered solely for first-time initial subscriptions, never for renewals or billing extensions.
- Formal Request Window: Any non-use withdrawal claim must be submitted within 14 calendar days of the initial purchase date by emailing contact@terrabi.fr.
- Discretion Against Abuse: We reserve the right to decline refund requests in cases of bad-faith disputes, scraping attempts, account sharing, or violation of these Terms. Approved refunds will be reimbursed via the original payment method.
Acceptable Use
You agree not to use our Service to:
- Violate any applicable French, EU, or international laws or regulations.
- Infringe upon intellectual property or database producer rights.
- Attempt unauthorized access to our infrastructure, servers, or private API endpoints.
- Deploy aggressive automated scrapers, crawlers, or bots to harvest data from our platform.
- Interfere with or compromise the performance and integrity of the Service.
Property Information Disclaimer
The property valuations, price-per-square-meter calculations, rent ceiling estimates (loyer de référence), and energy performance indicators (DPE) displayed on Terrabi Immobilier are compiled algorithmically for informational and orientation purposes only. While we cross-reference official public datasets (such as DRIHL, OLAP, and ADEME Open Data), we make no legal warranty regarding the absolute accuracy, availability, or off-market status of any third-party listing. Users must perform their own legal due diligence and consult certified real estate and legal professionals before executing binding leases or sales agreements.
Intellectual Property & Database Rights
The Service, its proprietary algorithms, database structure, user interface, brand assets, and analytical workflows are the exclusive property of Terrabi Immobilier and are protected under French intellectual property law, the EU Database Directive (Directive 96/9/EC), and the French Intellectual Property Code (Code de la propriété intellectuelle, art. L. 341-1 et seq.). You may not reproduce, decompile, extract, or exploit any substantial portion of our software or database without prior express written consent.
Limitation of Liability
To the maximum extent permitted by French and European law, Terrabi Immobilier shall not be liable for any indirect, incidental, special, or consequential damages, including loss of housing opportunities, rental disputes, lost profits, or data loss arising from your reliance on the Service.
Termination
We reserve the right to suspend or terminate your account at any time without notice if you breach these Terms, attempt to abuse our infrastructure, or engage in fraudulent activities.
Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of France. In the event of any dispute, users are encouraged to seek an amicable resolution by contacting contact@terrabi.fr. Failing that, disputes shall be submitted to the competent courts of Paris, France, subject to mandatory consumer jurisdiction rules under French law.
Rental Application Transmission (Dossier de Location / Apply Now)
Apply Now is an optional digital pipeline that allows you to assemble your rental application dossier (Dossier de Location) and authorize Terrabi Immobilier to transmit it securely to a recipient you designate (such as a landlord, listing agent, or property manager).
1. What Terrabi Immobilier is, and is not (French Legal Status)
Technical Conduit & Metadata Indexer: Terrabi Immobilier is an independent technology provider, search engine, and metadata aggregator operating in strict compliance with Directive 96/9/EC and Article L. 341-1 of the French Intellectual Property Code (Code de la propriété intellectuelle). We index strictly public metadata (price, surface area, rooms, postal code, DPE) and deep-link directly to original publisher listings.
NOT a Real Estate Agency (Loi Hoguet Disclaimer): Terrabi Immobilier is NOT a real estate broker, agent, or property manager (agent immobilier) under the terms of French Law no. 70-9 of January 2, 1970 (Loi Hoguet). We do not hold a real estate card (Carte Professionnelle T / G), do not act as an intermediary in negotiations, do not collect rental deposits, and do not participate in or influence any landlord's leasing or tenant selection decision.
Using Apply Now creates no agency, brokerage, or fiduciary relationship. Terrabi Immobilier does not guarantee that your application will be reviewed, accepted, or lead to a signed lease (bail d'habitation).
2. User-Directed Transmission
You retain total control over your documents (such as identity papers, proof of income, and tax notices). You select what to include, choose the intended recipient, and authorize each dispatch. Terrabi Immobilier acts strictly as a secure technical conduit (hébergeur technique) at your explicit direction.
3. Accuracy and Document Authorization
You certify that all personal data, employment proofs, and financial records submitted are authentic, accurate, complete, and lawfully yours. Submitting falsified documents (faux et usage de faux, punishable under Art. 441-1 of the French Penal Code) is strictly prohibited. You assume sole legal responsibility for the contents of your dossier.
4. No Independent Verification
Unless explicitly labeled as an automated sanity check, documents transmitted via the Service are self-reported by the applicant and are not formally audited or certified by Terrabi Immobilier. Landlords and receiving agents remain solely responsible for performing their own legal verification.
5. Recipient Responsibilities & GDPR Compliance
Any landlord or professional agent receiving an application through Terrabi Immobilier must process it strictly to evaluate the specific rental opportunity for which it was submitted. Recipients must comply with French fair-housing regulations, anti-discrimination laws, and the EU GDPR, maintaining strict confidentiality and destroying or returning documents once the leasing decision is finalized.
6. Prohibited Use
You may not use the transmission pipeline to send fraudulent, malicious, discriminatory, or unlawful materials. Any attempt to abuse the transmission pipeline for identity fraud or harassment will result in immediate account termination and, where appropriate, referral to the competent French judicial authorities.
7. Security and Encryption
Application links are time-limited, encrypted, and access-logged. While Terrabi Immobilier implements modern cryptographic safeguards and security best practices, no digital transmission over the internet can be guaranteed as 100% immune from compromise.
8. Data Retention and GDPR Deletion
Application dossiers and supporting identity documents are stored securely for a limited operational period and are automatically deleted in accordance with our GDPR Data Retention Policy. You may request the immediate deletion of your dossier at any time by contacting contact@terrabi.fr.
9. Disclaimer of Warranties
The Apply Now functionality is provided on an "as is" and "as available" basis without warranties of uninterrupted uptime or guaranteed landlord response.
10. Limitation of Liability
To the fullest extent permitted by French law, Terrabi Immobilier and its officers shall not be held liable for any lost housing opportunity, landlord rejection, or data interception outside our reasonable technical control. In any event, our maximum aggregate liability relating to application transmission shall not exceed one hundred Euros (100 €).
11. Indemnification
You agree to defend and hold harmless Terrabi Immobilier against any third-party claim, damages, or legal expenses arising from your submission of fraudulent documents, violation of these Terms, or infringement of third-party rights.
